Ukrainian Gambling Companies Will Pay Compensation For The Court Decision

Complaint of two ukrainian companies and the appeal of citizen states are partially satisfied in the european court of human rights (echr). The appeal to the court was associated with the ban of gambling business in ukraine.

Recall that the full ban of gambling business in ukraine was in 2009. The reason for the closure of gembling enterprises was a fire in the gambling institution of the dnieper, in which visitors died. After the incident of the license of gambling companies, first suspended by the decree of the ministry of finance of the law «about the ban of gambling business in ukraine».

The plaintiffs argued that the review of the license without paying compensation is interfering in the use of the right of ownership.

The decision of the european court of human rights states that the law regulating the procedure for issuing and using licenses did not contain the rules of their abolition in the event of a ban on gembling-activity. Also, the law did not provide for the temporary suspension of the action of permits for conducting operations related to gambling.

According to the echr solution, the ukrainian state undertakes to pay as compensation of llc «world of entertainment» €300 thousand., ooo «game beth» €58.5 thouusand., a citizen stetsenko – €135 thousand.

In addition, the state undertakes to cover the amount of legal costs – €17 thousand., €2.2 thouusand. And €214, respectively.

All the above amounts must be translated and paid in national currency.

Recall that, according to the presidentsky, the ban of gembling in the country should be canceled. The head of state believees that all adult citizens have the right to decide independently, participate in gambling or not.
